General conditions

The online store www.blackdogfoliage.com (hereinafter "the store") is managed by the company Petra Pahor s.p., (hereinafter the "seller"), Trnovec 3a, 1215 Medvode, registration number: 9375465000, tax number: 73388394, which is also a service provider e-businesses (hereinafter referred to as the seller or www.blackdogfoliage.com). The general terms and conditions define the operation, user rights and the business relationship between the seller and the buyer. The general conditions of the online store www.blackdogfoliage.com (hereinafter the seller) are drawn up in accordance with the Consumer Protection Act (ZVPot) and international codes for e-business. Access to information (summary of legislation) The provider undertakes to always provide the customer with the following information: 1. Company identity (company name and registered office, register number), 2. Contact information that enables the user to communicate quickly and efficiently (e-mail, telephone), 3. Essential characteristics of goods or services (including sales services and guarantees), 4. Availability of products (every product or service offered on the website should be available within a reasonable time) 5. Terms of product delivery or service performance (method, place and deadline of delivery), 6. All prices must be clearly and unequivocally determined and it must be clearly shown whether they already include tax and transport costs, 7. Method of payment and delivery, 8. Time validity of the offer, 9. The period during which it is still possible to withdraw from the contract and the conditions for withdrawal; in addition, also about if and how much it costs the customer to return the product, 10. Explanation of the complaint procedure, including all information about the contact person or customer service department.

Purchase process

Shopping cart The shopping basket stores the selected products and shows you their name, price, quantity and any other additional costs. You can check the contents of the basket at any time and add or remove selected products from it. You can remove products from the basket at any time by pressing the "x" button located next to the product. Purchase process If you are sure that you want to buy the products you have in your basket, then click on the "checkout" or "continue to checkout" button. The system will redirect you to a form where you enter the required data. After entering your information and delivery address information, you select a payment method. Read the terms of business and if you agree with them, click on the empty square in front of the inscription "I have read and agree to the terms of business of the website". Completion of purchase If everything is fine, confirm the order by clicking the "Buy now" button. If you have entered your correct e-mail address and telephone number in the data, you will receive an electronic confirmation of receipt of the order after completing the purchase process. Payment methods The provider allows the following payment methods: • Payment with PayPal • payment by Visa/Mastercard/Maestro/American Express debit or credit card

Prices

Prices Prices are valid at the time of placing the order and do not have a predetermined validity. The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions. Despite our best efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, the provider will allow the buyer to withdraw from the purchase, and at the same time the provider will offer the buyer a solution that will be mutually satisfactory. The purchase contract between the provider and the buyer is concluded the moment the provider confirms the order (the buyer receives an email about the status of the order confirmed). From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer.  

Delivery

Delivery Selection and delivery times Issuance of an invoice The provider attaches the invoice to the purchased items in the packaging with which the items are delivered. The invoice contains a breakdown of the price and all costs related to the purchase, as well as information about the buyer and the seller. The buyer is obliged to check the correctness of the data before placing the order. We do not take into account objections made later regarding the correctness of the issued invoices. The invoice is located in electronic form with the provider of corporate online services for issuing e-invoices. For a copy of the invoice, send a request to petra@blackdogfoliage.com. Communication

Communication The provider will contact the user via means of remote communication only if the user does not expressly object to this. Advertising emails will contain the following components: • they will be clearly and unequivocally marked as advertising messages, • the sender will be clearly visible, • various campaigns, promotions and other marketing techniques will be marked as such. The conditions of participation in them will also be clearly defined, • the method of unsubscribing from receiving advertising messages will be clearly presented, • the provider will expressly respect the user's wish not to receive advertising messages.  

Protection of personal data 

   The seller undertakes to permanently protect all personal data of the user. The seller will use personal data exclusively for the purposes of fulfilling the order (sending informative material, offers, invoices) and other necessary communication. Under no circumstances will the user's data be handed over to unauthorized persons. The user himself is also responsible for the protection of personal data, namely by ensuring the security of the computer and the system running on it, with which he makes orders.

 Complaints and disputes

 The seller complies with applicable consumer protection legislation. The seller makes every effort to fulfill his duty to establish an efficient complaint handling system and to designate a person with whom, in case of problems, the buyer can contact by phone or e-mail. The complaints procedure is available on the website, easy to use and confidential. Within five working days, the seller will confirm that he has received the complaint, inform the buyer how long he will process it and keep him informed throughout the process. Sellers are aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate proceedings before the court. Therefore, the provider makes every effort to resolve any disputes amicably. If this is not possible, the court in Ljubljana is competent for all disputes.  

  The right to withdraw from the purchase

Article 134 ZVPot (Official Gazette of the Republic of Slovenia, No. 130/22): In the case of contracts concluded at a distance or outside business premises, the consumer has the right to notify the company within 14 days that he withdraws from the contract without having to give a reason for his decision. Article 135 of the ZVPot (Official Gazette of the Republic of Slovenia, No. 130/22): Unless the contracting parties have agreed otherwise, the consumer does not have the right to withdraw from the contract referred to in the previous article in the case of these contracts: … 3. on goods that are perishable or expire quickly; In the case of the purchase of living organisms - plants, we do not recognize the 14-day right to withdraw from the contract, as they fall under the statutory exception - perishable goods. However, customers who have problems with the received plants are asked to contact petra@blackdogfoliage.com and together we will try to solve the problem. The buyer must notify the seller in writing of the intended return, no later than 14 days after receiving the goods. The goods must be returned within a period that must not exceed 60 days from the date of collection. The buyer is obliged to bear the costs incurred when returning the item of purchase. Important! The user may not use the goods unhindered during the period in which he can withdraw from the contract. The user may inspect and test the items to the extent necessary to determine the actual condition. Testing goods that deviate from the above is considered as use of the goods, which means that the user thereby loses the right to withdraw from the contract. Goods purchased at a distance are not intended to be used within the legal time for withdrawal from the contract. In case of withdrawal from the contract, the user must return the goods undamaged, unused, in the original packaging and in the same quantity and with all the accessories with which the goods were received. The packaging must not be opened in a way that causes it to be damaged, removed or altered. Returned goods must be equipped with all packaging and contents protection elements as installed by the manufacturer, in the condition as installed by the manufacturer. An attempt to return goods that will obviously be used or damaged, will be rejected and will not be considered a return in accordance with the distance purchase return provisions as defined by applicable law. • The address for returning the goods to the seller is Trnovec 3a, 1215 Medvode. • We recommend that you use a delivery service that allows you to track the shipment and that you properly prepare the goods for transport (in doing so, use the original packaging or other suitable safe packaging) - we are not responsible for damage to the items that occurs during transport. • Shipping costs are always covered by the sender, unless otherwise agreed in advance. We do not accept ransom payments! • In the case of sending a product that does not meet the conditions for a return / withdrawal from the contract, the costs of resending it back will be charged to the customer (EUR 5.00) and must be settled according to the invoice before sending.

Refund of damaged goods

 In the event that the package is physically damaged, its contents are missing or shows signs of being opened, the buyer must initiate the complaint procedure with the delivery service. Together with the delivery service, we will make sure that the complaint is resolved in the shortest possible time. In the event of a complaint, the buyer may, in accordance with legal restrictions, request a replacement of the item, its repair or a refund of the purchase price. In the latter case, the seller reserves the right to charge the rent according to the current price list for the time the buyer used the goods, but no more than the amount by which the market value of the item decreased during and as a result of use.  

Complaints

 We do not accept complaints about products of plant origin, unless there has been an error on our part. The seller undertakes to eliminate all deficiencies as soon as possible, and cancellation of the order is not possible due to possible abuses. Each complaint is handled individually. The right to a refund in case of material defects is more precisely regulated by the provisions of the Consumer Protection Act.

Purchase notification process 

   Order in preparation After submitting the order, the buyer receives a notification by e-mail that the order has been accepted. The seller reviews the order, checks the availability of the ordered items and confirms the order or rejects it with a reason. The seller can call the buyer on his contact phone number to check the data or to ensure the accuracy of the delivery. Via e-mail, the seller informs the buyer about up-to-date information regarding the delivery of items. The seller does not assume any responsibility for damage caused by longer delivery times or non-delivery of items that are not in stock in their own warehouse. The order has been shipped The seller prepares and ships the article within the agreed period and informs the buyer about this by e-mail. In the event of an error, the buyer can notify the seller via e-mail petra@blackdogfoliage.com Order cancellation The consumer can cancel the order without additional costs until receiving an email that the order has already been shipped. Notification of cancellation of an order is possible exclusively via e-mail petra@blackdogfoliage.com. Please include the following information in your email: 1. In the title of the message Order cancellation and the order number 2. In the content of the message: • first and last name of the consumer • address of the consumer • order number

Information about the appeals procedure 

 The seller respects the applicable legislation on consumer protection and makes every effort to fulfill its duty to establish an effective Complaint Handling System. The customer can file a complaint via email at petra@blackdogfoliage.com. The seller will decide on the appeal as soon as possible, or at the latest within 8 days of receiving all the documentation required for the assessment. The seller will send a response to the complaint with appropriate explanations in writing to the customer's contact address. The customer has the right to object to the complaint. The provider will send a decision on the objection with appropriate explanations in writing to the customer's contact address within 15 working days. With this, the decision of Petra Pahor s.p. final and the internal appeal process closed. If the customer is not satisfied with the resolution of the complaint, he can file a lawsuit with the court of actual jurisdiction. Out-of-court settlement of consumer disputes In accordance with legal norms, the seller does not recognize any provider of out-of-court resolution of consumer disputes as competent for the resolution of a consumer dispute that the consumer could initiate in accordance with the Act on out-of-court resolution of consumer disputes. The seller of goods and services, which is engaged in online trade in the territory of the Republic of Slovenia, publishes on its website an electronic link to the platform for the online resolution of consumer disputes (SRPS). The platform is available to consumers at the electronic link http://ec.europa.eu/odr. The aforementioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
